I've bought what I thought to be a tk102 from ebay. Its giving its location via port 5002 however there's an error in the log and then device doesnt display green in the portal when online.
I am running Traccar 3.8 at the moment, does it need upgrading perhaps?

Yes, you need to upgrade to the latest release.
